Terms of Service

These Terms of Service ("Terms") form a binding legal agreement between you ("you", "user", "member") and Sell4Me.ie ("Sell4Me", "we", "us", "our"), the operator of the website at sell4me.ie and all associated subdomains, applications and services (collectively, the "Platform"). Please read them carefully. By accessing, browsing, registering for or using the Platform in any way you confirm that you have read, understood and agree to be bound by these Terms, our Privacy Policy and any other policies referenced here. If you do not agree, you must not use the Platform.
1. Acceptance and changes
By creating an account or otherwise using the Platform you accept these Terms. We may update these Terms from time to time to reflect changes in the law, our services, or operational requirements. The "Last updated" date above shows when the Terms were most recently changed. Material changes will be notified by email or by a notice on the Platform. Your continued use after changes take effect constitutes acceptance of the revised Terms.
2. Eligibility
- You must be at least 18 years old and legally capable of entering into binding contracts under Irish law.
- You must not be barred from using the Platform under the laws of Ireland, the European Union, or any other jurisdiction that applies to you.
- If you use the Platform on behalf of a business, you confirm you have authority to bind that business to these Terms.
- We may refuse, suspend or terminate accounts at our discretion where eligibility cannot be verified.
3. Your account
- You must provide accurate, current and complete information when registering and keep it up to date.
- You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
- You must notify us immediately at Support@sell4me.ie of any unauthorised use of your account.
- You may not transfer, sell or share your account with any other person.
- Creating multiple accounts to evade restrictions, manipulate auctions, or circumvent fees is strictly prohibited.
4. Our role — Sell4Me is a venue, not a party to the sale
Sell4Me.ie is an online marketplace that connects independent buyers and sellers in Ireland. We provide the technology, listing tools, messaging and auction infrastructure that enable users to transact with each other.
- We are not a party to any sale, contract, transaction or dispute between users.
- We do not own, inspect, possess, test, deliver, warrant or transfer ownership of any item listed on the Platform.
- We make no representations or warranties about the quality, safety, legality, accuracy or authenticity of listings, the truth of any user content, or the ability of sellers to sell or of buyers to pay.
- Any contract for sale is formed directly between the buyer and the seller and is governed by the law applicable to that contract.
5. Seller obligations
If you list an item on the Platform you confirm and agree that:
- You own the item, or are otherwise legally entitled and authorised to sell it.
- The listing, including title, description, photographs, condition, category and price, is accurate, complete and not misleading.
- The item complies with all applicable Irish and EU laws, including consumer protection, product safety, electrical safety, age-restriction, tax, customs and intellectual property law.
- Where you sell in the course of a business ("trader"), you will comply with all consumer law obligations including the Consumer Rights Act 2022, the EU Consumer Rights Directive, the right of withdrawal where applicable, statutory warranties, VAT registration and invoicing.
- You will respond to buyer enquiries promptly, honour winning bids and accepted offers, and complete sales in good faith.
- You are solely responsible for declaring and paying any income tax, VAT, customs duty or other charges arising from your sales.
- Buy Now is a business-only feature. The instant on-platform purchase option ("Buy Now") can only be enabled by sellers on a business account. Standard-account holders cannot activate Buy Now on their listings. Where Buy Now is enabled, the seller will receive the buyer's details by email upon order confirmation so they can arrange fulfilment.
- Postage is entirely your responsibility. Sell4Me does not book, supply, print, pay for or arrange any postage labels, tracking numbers, carrier collections or shipping insurance. You choose one of three postage modes when listing: (i) Collection only — buyer collects in person; (ii) Postage included — postage cost is absorbed in your asking price; (iii) Postage charged separately — a postage amount you set is added to the item price at checkout. Whichever mode you choose, you are solely responsible for safely packaging the item, paying for and obtaining the postage label from a carrier of your choice (e.g. An Post), entering the tracking number into the order, marking the order as posted, retaining proof of postage, and arranging any shipping insurance you require. Risk of loss or damage in transit lies between you, the buyer and the carrier — not with Sell4Me.
- You will not cancel, withdraw or refuse to complete an auction sale once a winning bid has been accepted, except where required by law or where the buyer has clearly breached these Terms.
6. Buyer obligations
- You will read listings carefully and ask questions before bidding or buying.
- Verify the seller before you pay. Sell4Me is a venue and does not vet, endorse, identity-check or guarantee any seller. Before placing a Buy Now order or bid, you should review the seller's profile, ratings, listing history and message responses, ask any clarifying questions through in-app Messages, and satisfy yourself that the seller is genuine. If a listing or a seller's behaviour looks suspicious (unusually low price, pressure to pay off-platform, refusal to use Messages, requests to communicate via external apps), do not transact — report it to Support@sell4me.ie.
- Placing a bid on an auction is a legally binding offer to purchase the item at that price. If you are the winning bidder you are contractually obliged to complete the purchase. Vehicles are excluded — inspection is required and a vehicle auction win is conditional on satisfactory inspection.
- You will pay the agreed price and arrange shipment details with the seller without unreasonable delay.
- You will not use the Platform to defraud, harass, threaten or unfairly leverage sellers.
- You will not retract bids except where permitted (for example, where the seller has materially changed the listing or where Irish law gives you a withdrawal right).
- Any consumer rights you have apply against the seller, not against Sell4Me.
6A. Buy Now and on-platform postage — payments and buyer protection
Buy Now is available to business-account holders only.Sellers on a standard (non-business) account cannot enable Buy Now on their listings. Businesses may enable instant on-platform purchase ("Buy Now") on eligible non-auction listings (for example clothing, kids, leisure, electronics and similar postable categories). When a Buy Now order is confirmed, the business seller receives the buyer's details by email so they can arrange fulfilment.
At listing time the seller picks one of three postage modes: Collection only, Postage included in the asking price, or Postage charged separately (a postage amount the seller sets is added at checkout and collected together with the item price). Sell4Me does not provide, book or pay for postage labels or tracking — the seller arranges postage with a carrier of their choice (typically An Post) and enters the tracking number into the order. The payments, hold and buyer-protection arrangements described below apply to every Buy Now sale, whichever postage mode the seller selected.
How payments are held
Where a listing is marked "Buy Now", payment is processed and held by our regulated payments partner Stripe Technology Europe, Limited ("Stripe"), an Electronic Money Institution authorised by the Central Bank of Ireland (reference C187865). All buyer funds are received into, safeguarded in, and released from Stripe's own regulated safeguarded accounts under Stripe's licence and the European Union (Payment Services) Regulations 2018 (S.I. No. 6/2018).
Sell4Me does not, at any time, take possession or control of buyer or seller funds. Sell4Me does not operate a payment account, wallet, stored balance or client-money account, and is not a payment institution, electronic money institution, escrow agent, custodian or guarantor. Sell4Me's role is limited to (i) operating the marketplace, and (ii) communicating pre-agreed, rule-based payout and refund instructions to Stripe on behalf of the seller and the buyer in accordance with these Terms.
By listing a Buy Now item, the seller appoints Sell4Me as their limited, non-discretionary agent solely for the purpose of communicating these pre-agreed payout, hold and refund instructions to Stripe. By purchasing a Buy Now item, the buyer acknowledges that their payment is received by Stripe and that the buyer's payment obligation to the seller is satisfied at the point Stripe receives cleared funds for the seller's benefit.
Buyer protection
The buyer-protection arrangements below apply only to Buy Now purchases — they do not apply to private sales, off-platform deals, auction sales, or any payment made directly to a seller outside the Buy Now flow.
- Held by Stripe pending release. The seller's share of each Buy Now sale is held in Stripe's safeguarded accounts from the date of payment. Stripe releases it to the seller's connected Stripe account when whichever of the following pre-agreed conditions is first met: (a) the buyer clicks "Confirm received" in My Orders, in which case release is triggered immediately; or (b) 7 days pass from the date the seller marked the order as posted with no refund request, in which case release is triggered automatically. These conditions are applied automatically and not at Sell4Me's discretion.
- If the seller never posts. If the seller has not marked the order as posted, the seller's share is not released and continues to be held by Stripe. The buyer may request a refund (see below).
- "Item not received" or "not as described" — refund request window. A buyer may submit a refund request through the "My Orders" page where either: (a) 7 days have passed since payment and the seller has not marked the order as posted; or (b) 14 days have passed since posting and the parcel has not been confirmed delivered. The same channel is used to raise a "not as described" complaint once the item is received.
- Refunds cover the item cost only — postage is non-refundable. Where a refund is issued for a Buy Now order, the refund covers the item price only. Any postage charge collected at checkout is non-refundable, because the seller arranges and pays for postage themselves and the cost is not recoverable from the carrier once a label has been bought or a parcel handed over. This applies whether the seller issues the refund voluntarily, the refund is agreed following a dispute, or the refund follows an "item not received" or "not as described" request.
- Loss or damage in transit. Sell4Me does not provide postage labels, tracking or shipping insurance and is not responsible for any item that is lost, delayed, damaged, stolen or mis-delivered in transit. Any claim for loss or damage must be pursued by the seller (and, where relevant, the buyer) directly with the carrier or under any shipping insurance the seller chose to purchase.
- Seller issues the refund. Refund requests are not processed automatically. The seller is notified and is responsible for issuing the refund from My Sales once satisfied that the buyer's claim is valid (or for resolving the matter with the buyer in Messages). Where the seller does not respond or unreasonably refuses a valid claim, the buyer should contact Support@sell4me.ie and Sell4Me may, at its discretion, instruct Stripe to process the item refund on the seller's behalf.
- Confirming receipt closes the refund window. Clicking "Confirm received" ends the in-app "Item not received" refund right and triggers immediate release by Stripe of the seller's payout. Buyers should only confirm once they have actually received the item and are satisfied with it.
- How refunds are processed. Approved item refunds are issued by Stripe back to the original payment card and typically appear within 5–10 working days. Where the funds have not yet been released to the seller, the item refund is taken from the held funds. Where the funds were already released, the seller's transfer is reversed for the item amount.
- Hard cutoff. The in-app "Item not received" function is available for 60 days from the date of payment. After this period buyers should raise the issue with us at Support@sell4me.ie or with their card issuer.
- Honest use. The "Item not received", "not as described" and "Confirm received" functions may only be used in good faith. Submitting a false report — for example to obtain both the item and a refund, or to harass a seller — is a serious breach of these Terms. We may reverse refunds, suspend or terminate accounts, refer matters to An Garda Síochána, and pursue recovery of any sums improperly refunded.
- Sell4Me dispute review. To investigate a refund dispute (in particular "item not received" cases), authorised Sell4Me staff may review the in-app messages exchanged between the buyer and the seller about the relevant listing. By using the messaging system in connection with a Buy Now or auction purchase, you consent to this limited, dispute-related access. Access is logged and used only for dispute resolution, fraud prevention and compliance.
- Seller right of reply. Sellers who believe a refund was issued in error (for example, where proof of delivery exists) may contact Support@sell4me.ie within 14 days of the refund. Where the evidence supports the seller, Sell4Me may, at its discretion, instruct Stripe to reverse the refund and re-credit the seller.
- Card chargeback rights are unaffected. These arrangements are in addition to, not in place of, any rights you have to dispute a charge with your card issuer or under applicable consumer law.
- Statutory consumer rights. Where the seller is acting as a trader (a business), the buyer's statutory rights under the Consumer Rights Act 2022 and EU consumer law apply directly against that trader and are not reduced by these arrangements.
The buyer-protection mechanism described above is a goodwill facility operated on top of Stripe Connect. It does not make Sell4Me a party to the underlying sale, a payment service provider, an insurer or a guarantor of seller performance, and it does not extend to disputes about the quality, condition, authenticity or fitness for purpose of an item — those remain matters between the buyer and the seller and, where applicable, the seller's trader obligations.
7. Prohibited items and conduct
You must not list, offer or solicit any of the following on the Platform:
- Weapons, firearms, ammunition, explosives, knives intended as offensive weapons.
- Illegal drugs, drug paraphernalia, prescription medicines and unapproved health products.
- Counterfeit, replica or unauthorised copies of branded goods.
- Stolen goods or items the seller is not authorised to sell.
- Live animals, human remains, body parts or bodily fluids.
- Hazardous, recalled, expired or unsafe products.
- Hate material, content that incites violence, child sexual abuse material, or any other content unlawful in Ireland.
- Tobacco, vaping products, alcohol or other age-restricted goods unless permitted and properly age-gated.
- Financial instruments, currency, lottery tickets, gambling stakes.
- Any item whose sale would breach Irish law, EU law or third-party rights.
You also agree not to:
- Use bots, scrapers, crawlers, automated bidding tools or any non-public API to access, copy or interact with the Platform.
- Manipulate auctions through shill bidding, fake accounts, collusion, bid retraction abuse or off-platform side deals to evade fees.
- Post misleading, defamatory, obscene, harassing or discriminatory content.
- Send unsolicited commercial messages (spam) through the messaging system.
- Interfere with the security, integrity or performance of the Platform, attempt to gain unauthorised access, or probe for vulnerabilities other than through a responsible disclosure to Support@sell4me.ie.
- Use the Platform to develop, train or benchmark any competing product or AI/ML model.
We may, without notice, remove listings, restrict features, suspend or terminate accounts, and report users to the Gardaí or other authorities where we reasonably believe these Terms or applicable law have been breached.
8. Fees
Listing fees, subscription fees, promotional upgrades and any other charges are displayed at the point of purchase and are payable in advance. Sell4Me is not currently VAT-registered, so no VAT is charged on its fees. Fees are non-refundable except where required by law or expressly stated in writing by Sell4Me.
9. Auctions — additional terms
- Bids are binding offers to buy at the bid amount (subject to any reserve).
- The seller is contractually committed to sell to the highest valid bidder at or above any reserve.
- For non-vehicle auctions, the buyer must confirm acknowledgement of the legally binding nature of the bid before placing it.
- For vehicle auctions, the winning bid is conditional on the buyer's satisfactory inspection of the vehicle. Buyers must inspect promptly and in good faith.
- Where the seller has enabled postage on an auction listing (postage included in the asking price, or postage charged separately), any postage amount is collected by Stripe alongside the winning bid. The seller is solely responsible for arranging and paying for postage with the carrier of their choice — Sell4Me does not provide labels or tracking.
- Sell4Me may cancel a bid or auction where we reasonably suspect fraud, manipulation, an obvious listing error, or breach of these Terms.
Auction payments, hold and refunds. When the winning bidder pays for an auction through the Platform, the payments, safeguarded-hold, payout-release and refund arrangements in section 6A apply to that auction payment in the same way as a Buy Now order. In particular: (i) buyer funds are received and held by Stripe, not by Sell4Me; (ii) the seller's share is released when the buyer confirms receipt or 14 days after the parcel is posted, whichever is first; (iii) the buyer may raise an "item not received" or "not as described" request from My Wins within the same protection windows; and (iv) any refund issued in respect of an auction sale covers the item (hammer) amount only — any postage amount is non-refundable, on the same basis as Buy Now orders, because the seller arranges and pays for postage with their own carrier and that cost is not recoverable. Loss or damage in transit is a matter between the seller, the buyer and the carrier — Sell4Me accepts no liability for it. Refunds on auction sales are issued by the seller from My Earnings, subject to Sell4Me's right to step in where the seller does not respond to a valid claim.
10. Ad lifecycle and data retention
Active ads run until their listed expiry date, at which point their status is automatically changed to "expired" and they're removed from public search results. Expired ads remain in your account for 60 days so you can review or relist them.
After 60 days in the expired state, ads are permanently deletedfrom our database, along with any images uploaded with them. This deletion is irreversible — once an ad is purged we cannot recover its content, photos, view counts, or message history attached to it. Please save anything you want to keep before the 60-day window closes.
Records required for legal, tax, accounting or fraud-prevention purposes (for example invoices, payment records and auction transaction history) are retained separately for the periods required by Irish and EU law, even after the underlying ad is deleted.
11. Intellectual property — our rights
The Platform, including the Sell4Me.ie name, logo, branding, design, layout, look and feel, user interface, source code, database structures, category taxonomy, copywriting, illustrations, icons, audio, video, compiled bytecode and all related documentation, is owned by Sell4Me or its licensors and is protected by Irish, EU and international copyright, trade mark, database, design right, trade secret and other intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Platform for the personal, non-commercial purpose of buying or selling on Sell4Me. No other rights are granted, by implication or otherwise.
You must not, and must not permit any third party to:
- Copy, reproduce, mirror, frame, republish, scrape, harvest, index (other than by lawful public search engines), or otherwise extract any substantial part of the Platform, its listings database or its content.
- Reverse engineer, decompile, disassemble, translate or attempt to derive the source code of any part of the Platform, except to the extent expressly permitted by mandatory law.
- Modify, adapt, create derivative works of, or build a competing service from any part of the Platform, its design, code, taxonomy, copy or feature set.
- Use any Sell4Me trade mark, logo, get-up or distinctive branding without our prior written consent.
- Remove, obscure or alter any copyright, trade mark or other proprietary notice.
- Use the Platform, its content or any output to train, fine-tune, evaluate or build any artificial intelligence or machine learning system.
- Use the Platform to create, develop, market or launch a product, service or marketplace that competes with Sell4Me.
We assert database rights under the European Union (Copyright and Related Rights) Regulations and equivalent rights in our listings catalogue. Systematic extraction or re-utilisation of substantial parts of our database is expressly forbidden and will be enforced.
12. Your content — listings, photos and messages
You retain ownership of the content you submit to the Platform ("User Content"), including listing text, photos, videos and messages. By submitting User Content you grant Sell4Me a worldwide, royalty-free, sublicensable, transferable, non-exclusive licence to host, store, cache, reproduce, adapt (for resizing, formatting, watermarking and similar technical purposes), publish, display, distribute and promote that content on and in connection with the Platform, including in marketing of the Platform itself. This licence ends a reasonable time after you delete the User Content, except for content already shared with other users (such as messages) and copies retained for legal or backup purposes.
You warrant that:
- You own or have all necessary rights, licences and consents to grant the licence above.
- Your User Content does not infringe any third-party copyright, trade mark, design right, database right, privacy right, publicity right or other right.
- Your User Content is not unlawful, defamatory, obscene, misleading or otherwise in breach of these Terms.
- You will not upload images you do not own (for example, copying photos from another seller's listing or from the manufacturer's website without licence).
13. Copyright complaints and takedowns
Sell4Me respects intellectual property rights. If you believe that material on the Platform infringes your copyright, trade mark or other IP right, please send a notice to Support@sell4me.ie including:
- Your contact details and (where acting on behalf of a rights-holder) your authority to act.
- Identification of the protected work and the URL of the infringing material.
- A statement, made in good faith, that the use is not authorised by the rights-holder, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act.
- Your electronic or physical signature.
We may remove or disable access to allegedly infringing material and terminate repeat infringers. Knowingly false notices may attract liability.
14. Messaging and reviews
The Platform's messaging system is for communications about listings, sales and shipment. Do not use it for unsolicited marketing, abuse, harassment, sharing of personal contact details before reasonably necessary, or attempts to take transactions off-platform to evade fees. We may scan messages automatically to detect fraud, abuse or breaches of these Terms. Any reviews or feedback must be honest, factual and not defamatory.
15. Privacy and data protection
Personal data is processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR) and the Data Protection Acts 1988–2018. You must handle any personal data you receive from other users (for example a buyer's shipping address) only for the purpose of completing the relevant transaction and in compliance with data protection law.
16. Suspension and termination
You may close your account at any time from your profile settings. We may suspend or terminate your account, remove listings, withdraw services and refuse current or future use of the Platform, with or without notice, where we reasonably believe you have breached these Terms, applicable law, or where required to protect the Platform or other users. Termination does not affect rights and obligations that have accrued before termination, including obligations to complete outstanding sales and pay outstanding fees. Provisions of these Terms that by their nature should survive (including IP, indemnity, liability, governing law) survive termination.
17. Disclaimers
Except as expressly stated in these Terms and to the maximum extent permitted by law, the Platform is provided on an "as is" and "as available" basis without warranties or conditions of any kind, whether express, implied or statutory. We do not warrant that the Platform will be uninterrupted, error-free, secure, free of viruses, or that defects will be corrected. We disclaim all implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement to the fullest extent permitted by law.
18. Limitation of liability
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Irish law, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of statutory consumer rights that cannot be excluded.
Subject to the paragraph above, to the maximum extent permitted by law:
- Sell4Me is not liable for any loss or damage arising from disputes between users, the acts or omissions of any user, the condition, safety or legality of any item listed, or any failure of a user to complete a transaction.
- Sell4Me does not vet, identity-check, endorse or guarantee any user. Buyers are responsible for satisfying themselves that a seller is genuine before paying or bidding, and Sell4Me is not liable for losses arising from fraudulent or misleading listings, impersonation, or a seller's failure to deliver. Suspected fraud should be reported to Support@sell4me.ie.
- Sell4Me does not handle, ship, insure or supply postage labels for any item and is not liable for any loss, theft, damage, delay or mis-delivery in transit. Postage and carriage are arranged solely between the seller, the buyer and the carrier.
- Sell4Me is not liable for any indirect, incidental, special, consequential, exemplary or punitive losses, loss of profit, loss of revenue, loss of business, loss of goodwill, loss of data or loss of opportunity.
- Our total aggregate liability to you arising out of or in connection with the Platform or these Terms in any 12-month period is limited to the greater of (a) the total fees you paid to Sell4Me in that 12-month period, or (b) one hundred euro (€100).
19. Indemnity
You agree to indemnify, defend and hold harmless Sell4Me, its directors, employees, contractors and agents from and against all claims, demands, actions, damages, losses, costs and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Platform; (b) your listings, sales, purchases or other transactions; (c) your User Content; (d) your breach of these Terms or any applicable law; or (e) your infringement of any third-party right.
20. Force majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, war, terrorism, civil unrest, strike, pandemic, governmental action, internet or telecommunications failure, cyber-attack, or power outage.
21. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign, transfer or sub-contract our rights and obligations, including as part of a sale, merger or restructuring of our business.
22. Entire agreement and severability
These Terms, together with the Privacy Policy and any policies referenced here, constitute the entire agreement between you and Sell4Me regarding the Platform and supersede all prior agreements. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect. No waiver of any provision is effective unless made in writing by us.
23. Governing law and jurisdiction
These Terms and any dispute arising out of or in connection with them (including non-contractual disputes) are governed by the laws of Ireland. The Irish courts have exclusive jurisdiction, save that consumers resident in another EU Member State may also bring proceedings in the courts of their place of residence as required by applicable law. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
